Haddon, Morgan & Foreman is thrilled to announce that partners Adam Mueller, Jeffrey Pagliuca, Laura Menninger, and Ty Gee, and associate Meredith O’Harris prevailed in the United States Court of Appeals for the Tenth Circuit on behalf of their client, Michael Valdez. In a unanimous published decision, the Tenth Circuit affirmed a jury’s award of $2.4 million dollars in favor of Michael and against the City & County of Denver. Nearly 8 ½ years ago, Michael was in the wrong place at the wrong time. And for his trouble, Denver police officers fired at him nineteen times, all while Michael was lying on the ground with his hands above his head. It is no exaggeration to say that Michael is lucky to be alive. Despite these facts, Denver refused to give an inch, arguing that its officers acted reasonably. After hearing from Laura Menninger and Jeffrey Pagliuca, the jury had no problem seeing through Denver’s defense. And neither did the Tenth Circuit after hearing from Adam Mueller and Jeffrey Pagliuca.
