HMF wants to congratulate appellate public defender Karen Gerash, ACLU Colorado, and NACDL for the victory this week in the Colorado Supreme Court on behalf of our shared amicus client Rachel Niemeyer. Thankfully, the Colorado Supreme Court had the courage and conviction to find that Ms. Niemeyer was “in custody” for 5th Amendment purposes when her hands were zip-tied in bags, she was held at the police station against her will, and repeatedly denied the right to visit her dying husband in the hospital. This is a victory for all human rights.
